Terms of Service

Your agreement with FARMS.MARKET LLC, including your responsibilities, our role as a directory, and limits on liability.

Effective date:

1. These Terms

These Terms form an agreement between you and FARMS.MARKET LLC, a Wyoming, USA limited liability company ("we," "us," or "our"). They govern the FARMS.MARKET website, directory, and related account tools (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 to create an account or submit personal information. If you have not reached the age of legal adulthood where you live, a parent or legal guardian must agree to these Terms and supervise your use. If you act for a business or other organization, you confirm that you have authority to bind it to these Terms.

2. What the Service Does

FARMS.MARKET helps people find farmers markets and, where enabled, farms. You can search the directory, use the map, read public listing details, get directions, copy links, and contact listed businesses outside the Service. Farm listings depend on the deployment and may not appear in every version of the Service.

FARMS.MARKET does not sell goods, take orders, process payments, arrange shipping or delivery, or hold funds. We do not charge platform, listing, claim, transaction, or service fees. Any purchase or other deal takes place directly between you and the farm, market, vendor, or other party.

We do not act as a seller, market operator, broker, or agent for a listed business. We are not a party to your purchases, visits, or other dealings with it. The business is responsible for its products, prices, refunds, permits, food handling, labeling, taxes, and compliance with laws that apply to it. Resolve purchase and product disputes with that business.

Our Privacy Policy explains how we handle personal information. Using the Service does not by itself give consent to marketing or other uses that require separate consent.

3. Accounts and Sign-In

You can browse without an account. An account lets you save listings, record shares, submit listing requests and claims, report listing errors, and use profile controls. You sign in with a code sent to your email. The code confirms access to that email address. It does not prove that you own, run, or represent a farm or market.

Keep your email account and signed-in session secure. Do not share sign-in codes. Give us accurate information and email hello@farms.market if you think someone has used your account without permission.

4. Listings, Requests, and Claims

Directory details may come from public sources, listing contacts, users, or our review. Details can change. Check hours, location, products, payment methods, food assistance, and other important facts with the listed farm or market before you visit or buy anything.

Open/closed labels, map pins, distances, seasonal schedules, and directions are estimates based on the data available to us. They may not reflect closures, weather, road conditions, or last-minute changes. A listing does not grant permission to enter private property.

You may submit a new listing request. You must have the right to share its business and contact details. We review requests before publication and may approve, reject, or ask for more information. A submission does not guarantee publication or a review date.

You may ask to claim an unclaimed listing. We review each claim before linking it to an account. Email-code sign-in alone does not prove ownership or authority. Approved owners can edit descriptions, contact details, and hours. Market owners can also edit organization and season details. Saved edits can appear publicly. Changes to names, page addresses, and main locations require review. Submit only accurate details that you have the right and authority to publish.

Staff may also assign a listing to your account when they approve your listing request. Assignment does not mean that FARMS.MARKET inspected or endorsed the business.

If you delete an account, its public listings may stay in the directory without an owner.

A claimed or verified badge describes a directory status, not a government approval, inspection, or guarantee. We do not certify food safety, organic status, growing practices, licensing, insurance, or eligibility for SNAP, WIC, or other programs. Check those claims with the business or the relevant authority.

5. Favorites, Shares, and Reports

Signed-in users can save listings. When a signed-in user copies a listing link, the Service can count one share for that account and listing. Copying a link while signed out does not add an account share record. Counts reflect recorded activity, not reviews, verified visits, or endorsements.

Reports and contact messages must describe real issues. Do not submit false claims, private data you have no right to share, threats, spam, or unlawful content. A report does not guarantee a change or a response date.

6. Your Submissions

You keep any rights you hold in text and other material you submit. You grant FARMS.MARKET LLC a nonexclusive, worldwide, royalty-free license to store, copy, format, edit, and use that material to operate the Service. For material you submit for a public listing, this includes publishing and distributing it through the directory and public search results. We may allow service providers to carry out those tasks on our behalf. This license does not permit us to publish private account details or private messages as listing content.

The license lasts while the material remains part of the Service, including public listings that remain after account deletion, and for retained records as described in the Privacy Policy. It remains subject to privacy rights and removal duties that apply by law. You confirm that you hold the rights and permissions needed to grant this license.

Do not submit material that infringes another person's rights, breaks the law, contains malicious code, or misleads people about a listing, business, or your authority.

We may correct, decline, restrict, or remove submissions and revoke listing access when authority or accuracy is disputed. We do not promise to review every edit before it appears or to detect every false statement.

7. Acceptable Use

You may not:

  • break the law or another person's rights through the Service
  • impersonate a person or business or misstate your authority
  • probe, disrupt, overload, or bypass the Service or its security
  • use automated requests that harm the Service or other users
  • send spam, malware, or deceptive content
  • collect personal contact details from the Service for spam, harassment, or unlawful use

8. Third-Party Services

Listings may link to maps, websites, social accounts, email addresses, and phone numbers run by others. We do not control those services or their content, terms, privacy practices, goods, or conduct. Use them at your own discretion.

9. Our Content

FARMS.MARKET and its site design, software, text, and graphics belong to us or our licensors. These Terms let you use the Service for its intended purpose. They do not transfer our rights to you. Business names, logos, and content in listings may belong to their owners.

Public-source data, open-source software, and map data remain subject to their own rights and license terms. If you believe content infringes your rights, email hello@farms.market with the page URL, the material at issue, your basis for the claim, and a way to contact you.

10. Availability and Account Action

We may change, pause, or end features, listings, or the Service. We may limit or end access when an account breaks these Terms, creates risk, or harms the Service or its users. You may stop using the Service at any time and may delete your account from your profile.

Ending access does not end provisions that by their nature must continue, including retained-content rights, liability limits, responsibility for business submissions, and dispute terms, subject to applicable law.

11. Disclaimers

To the extent the law permits, we provide the Service and its information "as is" and "as available," without express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not promise uninterrupted, error-free, or secure access, or complete, current, or correct listings. A listing, claim, badge, or link does not mean that we endorse or inspect a business, product, food, practice, or event.

Directory and article content provides general information, not medical, dietary, legal, or food-safety advice. We do not assess whether a product suits your health needs or is free from allergens or contamination. Confirm ingredients, handling, and safety with the seller and seek qualified advice where needed.

12. Limits on Liability

To the extent the law permits, FARMS.MARKET LLC and its members, officers, employees, and agents will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages, including lost profits, business opportunities, or data, arising from the Service, directory information, third-party services, or dealings with listed businesses. This applies regardless of the legal basis of a claim, even if we were advised that such loss was possible.

These exclusions apply only where lawful. Nothing in these Terms excludes liability for our fraud, willful misconduct, gross negligence, or any injury or loss that the law does not allow us to exclude. Nothing waives consumer rights or remedies that cannot lawfully be waived.

13. Business Submissions

If you use the Service on behalf of a business, that business agrees, to the extent the law permits, to reimburse FARMS.MARKET LLC for reasonable costs, damages, and legal fees from third-party claims caused by its unlawful submissions, infringement of another person's rights, or false claims of authority. This obligation does not cover losses caused by our own unlawful conduct, negligence, or breach of these Terms. We will give prompt notice of a claim and a reasonable opportunity to participate in its defense. No settlement may impose obligations on the business without its consent.

14. Governing Law and Disputes

Wyoming law and applicable United States federal law govern these Terms, without applying conflict-of-law rules. Unless mandatory law gives you the right to bring a claim elsewhere, you and FARMS.MARKET LLC agree to bring disputes arising from these Terms or the Service in state or federal courts in Wyoming that have jurisdiction. This does not take away mandatory consumer protections where you live.

You may email hello@farms.market to seek an informal resolution. Doing so is not a condition of using a legal remedy and does not extend a legal filing deadline.

15. General Terms

If a court finds a provision unenforceable, the remaining provisions continue to apply to the extent allowed by law. A delay in enforcing a provision does not waive it. These Terms form the agreement for use of the Service and do not create a partnership, employment, or agency relationship between you and us.

16. Changes to These Terms

We may update these Terms as the Service changes. We will post the revised text and effective date on this page and give additional notice or seek agreement when the law requires it. Changes apply prospectively from their effective date. Your continued use after that date is subject to the revised Terms, except where the law requires separate agreement.

17. Legal Contact

FARMS.MARKET LLC, Wyoming, USA. Send questions, legal complaints, or notices about these Terms to hello@farms.market. Include the relevant page or account and enough detail for us to review the issue. Do not send passwords or sign-in codes. This contact method does not replace any formal service of legal process required by law.
